ALEC- Big corporation “bill mill” members revealed, has local ties

Revealing a “bill mill” member list that has numerous corporate influences has proven to be a difficult task. Although no one really appears to want to be associated with this group, the list has been evasive but not insurmountable.

In case you were wandering, TN State Rep 24 District Kevin Brooks and State Senator 9th District Mike Bell are on this list with Julia Hurley, Gerald McCormick and recently RINO hunted and ousted Debra Maggart.

ALEC’s own website misdirected me and left me with no results when I pressed the tab for a complete membership list. This prompted me to request via email to a Mrs K. Jones to reveal that list, which at the time of this posting has not been answered.

The level of influence this semi secretive fascist group has on legislation that hits the State Senate and House floor is phenomenal. ALEC boasts about a thousand successful bills that have ranged from cutting large corporate taxes to defunding public schools and shifting public money to private education.

Largely this group identifies itself as a conservative group with grassroots ties but many of their proposed bills over the years has suggested otherwise.

Scanning over the list of elected and non elected officials I see many RINOs (Republicans in Name Only) tied to NGOs (Non Governmental Organizations) and PPPs (Public Private Partnerships)

It does not surprise me that the Gates Foundation recently donated almost a half million dollars to the group to promote educational And other issues but later pulled it’s membership but left it’s donation. Sort of tells me they were in and out with the cash. Sort of like a lobbyist would do to get a bill passed.

The KOCH brothers essentially creating and funding this organization with many corporate membership fees deepens the involvement of the bureaucracy that is influencing our elected officials and getting their bills to the house floor. Being of multi billion dollar oil fortunes, it again doesnt surprise me that around 15 oil companies are on the corporate list of manipulators.

Struggling public schools are meeting heavier challenges as ALEC passes legislation through it’s educational committee that is crippling the local education cash flow. Our very own 24th District Tennessee State Representative Kevin Brooks is on the education board.

I am all about we need to reign in our public schools and the endless flow of taxpayer dollars that get sucked up by huge vacuums of red tape and lucrative paying jobs for top brass. I think it is more important to recognize those that are behind the scenes making this more difficult. Our State Legislator publicly supports public education but the “model legislation” that cones out of ALEC is the opposite. I am preparing a blog about the bills that have been passed through ALEC’s Education committee to support my claim. The info is out there it is just disguised very well and warrants many hours of research to expose it.

Take a look at the people, the companies and the outside organizations, many international, that are working with ALEC (American Legislative Exchange Council) to influence legislation that affects you.

At first glance you think these bills that are being tossed out of ALEC are the genius of a very productive legislator or Senator, when in fact they are nothing more than a clone of a big corporation with an avenue to destroy the free market through favoritism and manipulation.

ALEC is a corporate bill mill. It is not just a lobby or a front group; it is much more powerful than that. Through ALEC, corporations hand state legislators their wishlists to benefit their bottom line. Corporations fund almost all of ALEC’s operations. They pay for a seat on ALEC task forces where corporate lobbyists and special interest reps vote with elected officials to approve “model” bills. What is ALEC?
The American Legislative Exchange Council-(ALEC)

BCN Note- Deep within our state legislative and Senate house a semi secretive organization exists that wines and dines select State Legislators and State Senators in hopes of grabbing a vote on “model legislation” that favors big corporations and essentially leaves the little guy at a steep disadvantage.

While many fail to mention they are in this covert group, understandibly many can easily see how one can adapt to the loss of memory if the kick back or benefit of membership into this club is high enough.

These elected officials are coerced into passing or submitting legislation that favors huge business with lucrative trips and gifts. Some have even been known to accept a stripper or two according to some sources. They sit side by side with leaders of large corporations that directly influence coporate policy in exchange for a bill and a vote that passes the muster.

The free market was designed to function as a complete entity separate from manipulation and coercion. It cannot exist as long as a few have the power and influence. This action will somehow tip the balance severing the free market and causing it to collapse as we are seeing now as we inch closer to a depression.

You will have a real tough time believing who locally is on this corporate panel that favors large corporations. The hand is out once again and it’s saying “show me the money!” I am working on a list of Senators and legislators who participate in this ample reward club.

ALEC is not a lobby; (although it functions as one) it is not a front group (although it is a “think tank” for large corporations with plenty of money to blow on the lifeless soul of an elected official.

It is much more powerful than that. Through ALEC, behind closed doors, corporations hand state legislators the changes to the law they desire that directly benefit their bottom line.

Along with legislators, corporations have membership in ALEC. Corporations sit on all nine ALEC task forces and vote with legislators to approve “model” bills. They have their own corporate governing board which meets jointly with the legislative board. (ALEC says that corporations do not vote on the board.) Corporations fund almost all of ALEC’s operations.

Participating legislators, overwhelmingly conservative Republicans, then bring those proposals home and introduce them in statehouses across the land as their own brilliant ideas and important public policy innovations—without disclosing that corporations crafted and voted on the bills.

ALEC boasts that it has over 1,000 of these bills introduced by legislative members every year, with one in every five of them enacted into law. ALEC describes itself as a “unique,” “unparalleled” and “unmatched” organization. We agree. It is as if a state legislature had been reconstituted, yet corporations had pushed the people out the door.

Who funds ALEC?

More than 98% of ALEC’s revenues come from sources other than legislative dues, such as corporations, corporate trade groups, and corporate foundations. Each corporate member pays an annual fee of between $7,000 and $25,000 a year, and if a corporation participates in any of the nine task forces, additional fees apply, from $2,500 to $10,000 each year.

ALEC also receives direct grants from corporations, such as $1.4 million from ExxonMobil from 1998-2009. It has also received grants from some of the biggest foundations funded by corporate CEOs in the country, such as: the Koch family Charles G. Koch Foundation, the Koch-managed Claude R. Lambe Foundation, the Scaife family Allegheny Foundation, the Coors family Castle Rock Foundation, to name a few.

Less than 2% of ALEC’s funding comes from “Membership Dues” of $50 per year paid by state legislators, a steeply discounted price that may run afoul of state gift bans. For more, see CMD’s special report on ALEC funding and spending here.

Is it nonpartisan as claimed?

ALEC describes itself as a non-partisan, non-profit organization. The facts show that it currently has one Democrat out of 104 legislators in leadership positions.

ALEC members, speakers, alumni, and award winners are a “who’s who” of the extreme right. ALEC has given awards to: Ronald Reagan, Margaret Thatcher, George H.W. Bush, Charles and David Koch, Richard de Vos, Tommy Thompson, Gov. John Kasich, Gov. Rick Perry, Congressman Mark Foley (intern sex scandal), and Congressman Billy Tauzin. ALEC alumni include: Speaker of the House John Boehner, House Majority Leader Eric Cantor, Congressman Joe Wilson, (who called President Obama a “liar” during the State of the Union address), former House Speaker Dennis Hastert, former House Speaker Tom DeLay, Andrew Card, Donald Rumsfeld (1985 Chair of ALEC’s Business Policy Board), Governor Scott Walker, Governor Jan Brewer, and more. Featured speakers have included: Milton Friedman, Newt Gingrich, Dick Cheney, Dan Quayle, George Allen, Jessie Helms, Pete Coors, Governor Mitch Daniels and more. (That’s a huge collection of mostly RINOs, a few exceptions perhaps)

What goes on behind closed doors?

The organization boasts 2,000 legislative members and 300 or more corporate members. The unelected corporate representatives (often registered lobbyists) sit as equals with elected representatives on nine task forces where they have a “voice and a vote” on model legislation.

Corporations on ALEC task forces VOTE on the “model” bills and resolutions, and sit as equals with legislators voting on the ALEC task forces and various working groups. Corporate and legislative governing boards also meet jointly each year. (ALEC says only the legislators have a final say on all model bills. ALEC has previously said that “The policies are debated and voted on by all members. Public and private members vote separately on policy. It is important to note that laws are not passed, debated or adopted during this process and therefore no lobbying takes place. That process is done at the state legislature.”)

The long-term representation of Koch Industries on the governing board means that Koch has had influence over an untold number of ALEC bills. Due to the questionable nature of this partnership with corporations, legislators rarely discuss the origins of the model legislation they bring home. Though thousands of ALEC-approved model bills have been publicly introduced across the country, ALEC’s role facilitating the language in the bills and the corporate vote for them is not well known.

(ALEC legislators sometimes compare the organization to the National Conference of State Legislators (NCSL), yet the two organizations could not be more different. NCSL has zero corporate members. It is funded largely by state government appropriations and conference fees; it has a truly bipartisan governance structure, and there is a large role for nonpartisan professional staff; it does not vote on or promote model legislation; meetings are public and so are any agreed upon documents. How do corporations benefit?

Although ALEC claims to take an ideological stance (of supposedly “Jeffersonian principles of free markets, limited government, federalism, and individual liberty”), many of the model bills benefit the corporations whose agents write them, shape them, and/or vote to approve them. These are just a few such measures:
Altria/Philip Morris USA benefits from ALEC’s newest tobacco legislation — an extremely narrow tax break for moist tobacco that would make fruit flavored tobacco products cheaper and more attractive to youngsters.

Health insurance companies such as Humana and Golden Rule Insurance (United Healthcare), benefit directly from ALEC model bills, such as the Health Savings Account bill that just passed in Wisconsin.
Tobacco firms such as Reynolds and pharmaceutical firms such as Bayer benefit directly from ALEC tort reform measures that make it harder for Americans to sue when injured by dangerous products.

Corrections Corporation of America (CCA) benefits directly from the anti-immigrant legislation introduced in Arizona and other states that requires expanded incarceration and housing of immigrants, along with other bills from ALEC’s crime task force. (While CCA has stated that it left ALEC in late 2010 after years of membership on the Criminal Justice Task Force and even co-chairing it, its prison privatization bills remain ALEC “models.”)
Connections Academy, a large online education corporation and co-chair of the Education Task Force, benefits from ALEC measures to privatize public education and promote private on-line schools.

How do legislators benefit?

Why would a legislator be interested in advancing cookie-cutter bills that are corporate give-aways for global firms located outside of their district? ALEC’s appeal rests largely on the fact that legislators receive an all-expenses-paid trip that provides many part-time legislators with vacations that they could not afford on their own, along with the opportunity to rub shoulders with wealthy captains of industry (major prospective out-of-state donors to their political campaigns).

For a few hours of work on a task force and a couple of indoctrination sessions by ALEC experts, part-time legislators can bring the whole family to ALEC’s annual convention, work for a few hours, then stay in swank hotels, attend cool parties — even strip clubs– and raise funds for the campaign coffer, all heavily subsidized by the corporate till. In 2009, ALEC spent $251,873 on childcare so mom and dad could have fun.

Is it lobbying?

In most ordinary people’s view, handing bills to legislators so they can introduce them is the very definition of lobbying. ALEC says “no lobbying takes place.” The current chairman of ALEC’s corporate board is W. Preston Baldwin III, until recently a lobbyist and the Vice President of State Government Affairs at UST Inc., a tobacco firm now owned by Altria/Phillip Morris USA. Altria is advancing a very short, specific bill to change the way moist tobacco products (such as fruit flavored “snus”) are taxed– to make it cheaper and more attractive to young tobacco users according to health experts.

In fact, 20 of the 24 corporate representatives on ALEC’s “Private Enterprise Board” are lobbyists representing major firms such as Koch Industries, Bayer, GlaxoSmithKline, Wal-Mart and Johnson and Johnson.
ALEC makes old-fashioned lobbying obsolete. Once legislators return to their state with corporate-sponsored ALEC legislation in hand, the legislators themselves become “super-lobbyists” for ALEC’s corporate agenda, cutting out the middleman. Yet ALEC enjoys a 501(c)(3) classification, which allows it to keep its tax-exempt status while accepting grants from foundations, corporations, and other donors.

In our view, the activities that corporate members engage in should be considered lobbying by the IRS, and the entity that facilitates that effort to influence state law, ALEC, should also be considered to be engaged predominantly in lobby-related activities, not simply “educational” activities. Re-classifying ALEC as primarily engaged in lobbying facilitation would mean that donations to it would not count as tax-deductible for businesses and foundations. Common Cause filed a complaint with the IRS on July 14, 2011, setting forth evidence supporting its complaint that ALEC is engaged in lobbying despite its claims to do no lobbying.

Is it legal?

ALEC’s operating model raises many ethical and legal concerns. Each state has a different set of ethics laws or rules. The presence of lobbyists alone may cause ethics problems for some state legislators. Wisconsin, for instance, generally requires legislators who go to events with registered lobbyists to pay on their own dime, yet in many states, legislators use public funds to attend ALEC meetings.

According to one study, $3 million in public funds was spent to
attend ALEC meetings in one year. Some legislators use their personal funds and are reimbursed by ALEC. Such “scholarships” may be disclosed if gifts are required to be reported. But should the legislators be allowed to accept this money when lobbyists are present at the meeting? Still other legislators use their campaign funds to go and are again reimbursed by ALEC; in some states, campaign funds are only allowed to be used to attend campaign events.
In short, many state ethics codes might consider the free vacation, steeply discounted membership fees, free day care or travel scholarships to be “gifts” that should be disallowed or disclosed.

Haslam, NASCAR, Cambodia, a trifecta of corruption.

With the Cambodian delegation long departed from Cleveland Tennessee and nestled into their little communist beds complete with Cleveland Tennessee made mattresses, Governor Bill Haslam was to entertain the Cambodian delegation to a race at the Bristol Motor Speedway.

To my knowledge, that did not happen and if it did it was very subdued and on the hush. I am guessing that Haslam got drift that it would not be such a good idea to be seen with this atrocious regime with quite a reputation for rape, murder, child exploitation and mass evictions. Not to mention connections to the Khmer Rouge, Prime Minister Hun Sen, UN human rights violations and communism.

Several calls to Governor Haslams office and to Bristol Motor Speedway could not confirm that the Cambodian/Haslam engagement did or did not happen. Neither side could confirm or deny the meetup although it was in their original itinerary as mentioned in the local news.

I can bet that he was given the heads up by a locally elected official of whom I will leave nameless only because at this point it involves speculation only.

I believe it would also be perceived as a conflict of interest for all of the trifecta to be in one setting with Governor Bill Haslam. Bill Haslam has once again shown his selfish roots as he seems to be attempting to merge his self interest with state affairs for personal gain.

Bill Haslam has been very interested in NASCAR, or at least his family business Pilot Oil has had an interest in racing, particularly Bristol racing. The Governors personal offer to entertain them at a race also shows his close involvement.

A few years ago Pilot Oil sponsored several racers and their cars, today they actively sponsor a car at the track. So it would be a natural of him to bring the Cambodian Delegation to a Bristol race and impress the Cambodians with his business interests in the raceway, perhaps initiating a courtship to future business ventures.

Bill has also recently been in negotiations with a Bristol Motor Speedway owner to secure state funds to restore the raceway to it’s natural surface. Not build them a new one but to restore it back. A few years ago the raceway owners thought it would be best to give the track a slotted surface unlike the original. Fan attendance has since went down and the owners have cited the new surface as a reason for poor attendance or so they say. Remember Haslam also carved out a half million from our Tennessee state budget to build a country music venue on the Virginia side of the Virginia/Bristol state line, another attempt to boost tourism in the area.

Now bring in the Cambodian delegation to Bristol ala host Bill Haslam. You may or may not be aware that Cambodia has recently discovered trillions of feet of oil under their feet. Oh to see that kinda cash. With the recent add of Samar Ali to his Tennessee Economic Development team what a great fit for her to travel to Cambodia to negotiate a deal with the Chams, Louns, remnants of Khmer Rouge and the leadership of Cambodia. And we thought this was about building homes for the poor that Kep Chuktema evicted. What a wonderful addition to the family of Pilot Oil would personal access to billions of barrels of oil would make. Throw in a mattress making outsourcing of American jobs via the Chamber of Commerce and the trifecta is complete.

This all started as a plight to help the poor and build them houses now because of big money and greed by a few open handed bureaucrats it has quickly become a dash to see how much money we can take in. Like a line from the Jerry Magwyer movie, the character played by Cuba Gooding Jr sums it up best when he shouts………”show me the money, SHOW ME THE MONEY!”

I am going to limit my words here to leave the emphasis on the obvious of what just happened in Cleveland Tennessee. Our Mayor Tom Rowland and our State Legislator Kevin Brooks and Governor Bill Haslam have welcomed one of the worst human rights offenders in the world to our city and we call them sister and give them the key to our city.

We were swept away with the pomp and circumstance as our Mayor bowed to a ruthless dictator while slipping him the key to our city. Where is the humanity in this? Where are the church leaders in our town that should be speaking up for these children and their parents being taken in and forced into slave labor, child prostitution and human trafficking? Why do we choose to turn a blind eye to the reality of our associations? How can Rowland, Brooks and Haslam not see this delegation for what they truly are? Why doesnt the rule of you are known by your associations apply here? How can we build these people up while ignoring their devilish and satanic actions?

I will tell you simply. We have once again sighted our vision in the almighty dollar instead of the humanity that suffers because of our actions. We can forget the action if it profits me!

We listen to others influential in all things business like the Chamber of Commerce. We instead ignore Gods voice of conviction that must lay heavy on these leaders hearts.

We have lost touch with the sense that while helping a few become wealthy while making a few spiritual leaders feel warm and fuzzy all over. The intended message has been eternally lost. Gods message to love thy neighbor and assist them when troubled has been watered down by an opportunity to outsource a mattress factory and spread the wealth. A child slaving over a mattress has become more important than giving that same kid a place to rest his head at night.

The assumed numerous children of Pol Pot living in Phnom Penh who have lived to tell the story of horrendous crimes and powerful regimes are now being further exploited by our elected leaders who would rather turn a blind eye to the iniquities of many for the promotion of self.

God bless our city and the misdirection it has received, bless our leaders as this regime is lifted to royalty. Please let’s take a look at the real people that we are gloating about and let’s put value on his excellency for what they really are……ruthless thugs with enough power to influence many to participate in the degregation of a generation of children and people and further chaining their feet to a communist/socialist regime that is being empowered by the elite a thousand miles away from them.

Please take the time to get to know these Cambodian delegates and sisterS of our city that have been given the key to our city by seemingly likeminded politicians who seem oblivious to the influence our support has on the futures of a generation where 50 percent of it’s population is under the age of 21. What a great opportunity missed to reach millions squandered on greed and pride.

Pleas take a few minutes to read from a news source inside Cambodia and Phnom Penh who see the light because it is shinin on them brightly.

I encourage you not to read the posted website if your stomach is easily upset or vivid images stick in your head for a long time that may produce PTSD side effects. What I read literally made me wash my hands with soap and water to remove the filth when I shook their hands! While you may choose to read with great hesitancy remember the greatest tragedy is how we have lifted this “delegation” up as the example of what our city needs to be.

Essence of evil permeates Chamber of Commerce as a host of City Leaders bow to Cambodian “dignitaries”

I want to mention that Kep Chuktema has forcefully evicted over 3000 urban poor families from the center of Phnom Penh during his tenure.  He has been quoted in the national papers as saying that the urban poor “pollute our city’s beauty”.  Most recently he evicted roughly 1,500 urban poor to a location without any basic services:  No running water, bathrooms, health clinics, schools, etc.  Literally dropped off over a thousand families into a barren ricefield during the rainy season.  The UN Special Rapporteur on Housing (Miloon Kothari) has described the trends occurring in Phnom Penh as approaching that of an ‘apartheid city’.  He has employed police and soldiers to carry out evictions, armed with electric batons, guns, gas masks, and riot gear.  The last eviction he used roughly 1,000 such ‘security’ forces, carried out the eviction at four in the morning, and refused to allow UN monitors, NGO human rights monitors, or the media from observing the evictions.

The above passage was written by a Cambodian begging for someone to hear his or her plight. It is the cry of the Cambodian people! Save me!

The Cambodians reaching out because of these and other atrocities by them at the hands of Kep Chuk Tema. Memories of Pol Pot and the Khmer Rouge still exists and the remnants of that horrible regime have made their way to America, specifically Cleveland Tennessee.

Rape, child rape, sex crimes and trade that are only echoed in horror chambers, drugs, abuse of women, evictions, bribery, murder and mass corruption these are there cries!

The cry of a child prostitute offering her self for “one dollar”, “one dollar” speaks of darkness that only a few know.

I am dumbfounded by the level of acceptance by our church leaders, elected officials, NGOs, the Chamber of Commerce, the Mayor Tom Rowland and any others that may wish to participate in this endeavor.

I find it interesting, we criminalize patriots for questioning land policy in Cleveland, yet embrace a delegation that has evicted, raped and pillaged hundreds of thousands in phnom penh and we give them the key to the city who are known Socialists/Marxist/Leninist with close ties to the Khmer Rouge, go figure!

The worst of human rights abuses are on the record and they were committed by the man and his government that we accept in Cleveland Tennessee with open arms. The atrocities that Mr Garmon and Mr George were the work of the man they are parading around in our town as a hero to his people. In Phnom Penh it is quite different.

The United Nations, yes it’s hard for me to say that, but their human rights board is investigating his Khmer Rouge/Apartheid type activity all in the name of sustainable economic development.

Why is he here in my opinion? The World Bank has cut off all his money for land development because of his human rights violations. So he accepts the offer from God fearing, freedom loving Americans that are more than willing to save the world. So, Mr Chuktema by building little cities, with the cooperation of the US of course shows some good will and is able to get his World Bank financing back. At the same time the Chamber of Commerce, the Mayor and Planners might get a business out of it!

This is truly the saddest part of this all. Our Church leaders and elected leaders that we trust to protect our sovereignty and freedoms end up giving them to a Buddhist/Socialist/Marxist/Leninist regime.

The people we are entrusting to lead us out of the economic downfall are the very ones that are doing the most to prevent a free market and capitalism to work. Let’s share the wealth! That is the game. Have you seen pictures of Phnom Penh lately? Do you think there is a shortage of cash in this area that needs or can get a step ahead by the generous tithing of a few hundred church faithful? 2.2 million to hand to a dictator that has the equivalency of a King and his court? To build 800 or so homes for a tyrannical leader that does not see the bad in evicting 200, 000 poor people from his kingdom? Why has he done this? It is to secure a sustainable future! Where if you offer enough money I will gladly displace thousands if your dream is to build a strip mall or a high rise apartment for the poor you just dumped in a rice paddy in the middle of nowhere. How can our churches and elected leaders participate in this apartheid! I thought we were about helping the poor, not benefitting from their demise.

CLEVELAND, Tenn. — Mayor Tom Rowland says the city has no reason to apologize for asking for a police investigation into who was distributing fliers to south Cleveland homes in June.

The fliers, which stated the city was planning to use eminent domain to take more than 300 homes in the name of development, were untrue, Rowland said Monday.

It is the Tea Party of Bradley County that needs to apologize for upsetting families, some of whom have lived in their homes for two generations or more, he said.

“They were in tears,” Rowland said.

At Monday’s City Council meeting, a lively, but civil, debate took place between council members and members of the Tea Party of Bradley County. In the end, the only common ground was that no one will apologize.

Donny Harwood, president of the Tea Party of Bradley County, said his organization has no reason to apologize, either. At the time they were distributed, the fliers were true, according to the latest public information, he said. It is the city that needs to apologize for intimidating the group’s members and seeking to deny them their right to free speech, he said.

The call for an investigation aimed to “essentially hunt down, arrest and expose members of our tea party group as we made efforts to inform the community of horrendous plans for their community,” Harwood said.

“This flier contained truthful information based on the last known public meeting,” Harwood said. The “white paper” on which the flier was based later was changed, he said.

“We haven’t stopped your free speech,” Rowland told Harwood.

“Have you passed any leaflets out to apologize to the 300 homeowners that this was not true?” he asked Harwood.

Rowland said the investigation was only to determine if laws were violated, and since none were the point is moot.

“If you are man enough, you will go down there and apologize,” he told Harwood.

“There is nothing for us to apologize about,” Harwood responded.

The group, he said, held a town hall meeting to seek explanations but only one councilman, Bill Estes, attended. Other council members, and Rowland, said they got the invitation after the meeting was held.

Tea party member Dan Rawls said that isn’t true because he sent the registered letters.

Councilman George Poe said he got a late invitation to a meeting to discuss something he had no intention of doing anyway.

“We couldn’t afford to buy 300 houses in the first place,” he said. “We have never talked about what we are accused of.”

If Harwood’s group was so alarmed, Poe said, they should have come to the council first with questions.

Rowland and Poe said they have not read the “white paper” from contracted consultants on which the flier was based. Harwood said the paper was handed out during a three-day public planning meeting at Bradley Square Mall.

Councilman Richard Banks, who said he has read the white paper, told tea party leaders they took the “300 homes” statement out of context. The original question was what would happen in the community if Whirlpool stayed in its old location, he said.

Consultants said that up to 300 homes might have to be seized through eminent domain to accommodate the company’s expansion there. But Whirlpool moved to its new Benton Pike site.

It was only a “what-if” discussion, Rowland said.

“There is nothing for us to explain, because there was nothing to it,” he said.

The Cleveland City Council became embroiled in a 40-minute argument Monday with Bradley County Tea Party President Donny Harwood over who should apologize for deceiving the public. In the end, neither side admitted wrongdoing.

Harwood approached the Council during the regular voting session regarding what he viewed as an action taken by the Council that impinged on party members’ freedom of speech.

The resulting exchange centered around a flier distributed in June by the local tea party and subsequent action taken by the Council on June 18.

“On June 18, I witnessed first-hand the Cleveland City Council and its Mayor Tom Rowland display behavior uncharacteristic of a free republic bound to the U.S., the state constitution and the city charter. With this most recent breach it is safe to say our first amendment rights are imperiled in Bradley County,” he said. “There is still egregious legislation on the books today that has yet to be reversed that limits our freedom of speech.

“Cleveland Mayor Tom Rowland, with a unanimous resolution vote of 7-0 by this Council ordered an investigation using police force to essentially hunt down, arrest and expose members of my Tea Party group as we made efforts to inform the community of horrendous plans for their community, thus criminalizing our free speech.”

Rowland said Monday there was no resolution. It was simply a vote taken after he expressed his opinion at the June 18 Council meeting that whoever anonymously distributed the flier should be publicly identified.

The anonymous flier was in neighborhoods south of the old Whirlpool Plant in downtown Cleveland. It warned homeowners of the impending loss of their property rights, if they did not immediately act. The flier stated 300 homes were targeted for demolition and redevelopment.

“I think this is a very cruel hoax on the citizens of our community. This is sneaky. It’s deceitful. I don’t like it and I don’t like my citizens to be in fear,” the mayor said in June.

He said then it was a gray area as to whether or not an actual crime was committed by distributing fliers containing false information about the future of the area and “whoever wrote this should be exposed to the public and to those people who called Greg (Planning Director Greg Thomas) with fear in their hearts. They ought to know who wrote this.”

The Council voted 7-0 to request the city attorney, police and district attorney’s office to fully investigate the matter to determine if any laws were broken and try to uncover the source of the flier. The matter was investigated. It was determined no laws were broken and no further action was taken.

“I think this flier is very inciting and I don’t find anything, other than some terminology here and there, that’s even true,” Rowland said during the June meeting. “We formed the Southside Development Committee, but that would do nothing but increase values in that area by getting rid of the blight in our city and enhance the value of the property around it.”

Harwood said Monday the flier contained truthful and accurate information based on the last known public meeting where the information was provided.

“The white paper draft plan is the last known information available to the public in a public setting,” he said. Since that time, he said the plan was changed in a private setting.

Thomas said in a June 17 interview the white paper was written by a Knoxville-based planning consultant and it was handed out to the public in April during a three-day planning workshop at Bradley Square Mall. Thomas said that was the first time he saw the white paper and subsequently, he requested that section be deleted. There have been no public meetings since April.

“The bottom-line answer is the city is not going to run in and take anybody’s property,” he said in June.

Cleveland/Bradley Chamber of Commerce Vice President for Economic Development Doug Berry said in July references to 300 houses came when talks first began with Whirlpool about replacing its century-old manufacturing facilities. The company wanted to remain in the downtown area where there is historical linkage because it is a big issue for a company to break that attachment.

“When we first sat down with Whirlpool, they told us they needed to develop modern manufacturing facilities, that the inefficiencies of these historic plants were so great it was having a bottom-line effect on the company,” Berry said. “They told us they would prefer to do a rebuild in the area of their existing plant. Their first request of me, as a representative of this community, was to provide them a redevelopment option for them to put two half-million square foot buildings in this corridor.”

Berry said during the July MainStreet Cleveland luncheon that such a redevelopment project has never happened in Cleveland. Ultimately, keeping the plant in its historical location would require the use of eminent domain. Berry said he expressed his concern to the company, but agreed to analyze what it would take to put a million square feet in the neighborhood. In order to do that, he said it would require buying all of the property between Plant No. 3 and Ocoee Street, all the way to Plant No. 2.

“That’s 300 lots. That’s where the 300 number came from,” Berry said. “I then sat down with the company and explained that I did not think this was a viable option because this community has not been through the process and has no history of ever having used eminent domain as part of its economic development program. When you hear about the 300 homes that are going to be taken and bulldozed, that number actually has basis, but it’s not fact in the conclusion of those statements,” he told MainStreet members.

Rowland asked Harwood on Monday if he had apologized to the 300 homeowners.

“They were alarmed that their houses might be taken when that’s not a fact,” the mayor said.

Harwood said, “There is nothing for us to apologize for.”

Rowland said, “You should go back and apologize to those people whose lives you have upset. Would you do that or not? We have not stopped your free speech. You have passed leaflets out since then and during that time you haven’t been stopped. We wanted to know who was doing it so you would know what you are passing out is not true. There is nothing true about it. This Council has not voted on it and you know good and well where it started — when Whirlpool said what if we build down there, it was said you might have to buy 300 houses. Period. Where did Whirlpool move to? That was irresponsible —”

“Well, the information —,” Harwood said.

“Listen to me!” the mayor demanded. “The only people I’ve talked to were in tears because somebody put some kind of information out that has no facts to it at all and if you’re man enough, you’ll go down there and tell them that you were wrong.”

The remainder of the argument centered mainly around Harwood and Tea Party member Dan Rawls asking Council members why they did not appear at a Tea Party town hall meeting to discuss the issue. Councilman Bill Estes, who represents the 2nd District, was the only councilman who accepted the invitation.

In return, Councilman George Poe asked Harwood why he didn’t attend a Council meeting months ago if he had questions.

Tea Party confronts Cleveland City Council on first amendment

Mayor Tom Rowland and City Council,

On June 18th, 2012 I witnessed first hand the Cleveland City Council and it’s Mayor Tom Rowland display behavior uncharacteristic of a free Republic bound to the US, the State Constitution and the Cleveland Charter.

With this most recent breech, it is safe to say that our 1st Amendment rights are in peril in Bradley County, Tennessee. There is still an egregious resolution on the books that has yet to be reversed that limits our freedom of speech.

Cleveland, Tennessee City Mayor Tom Rowland, with a unanimous resolution vote of 7 to 0 by his council, ordered an investigation using police force to hunt down, arrest and expose members of my group as we made efforts to inform the community of horrendous plans for their community, thus criminalizing free speech. Thankfully the local Sherrif and the 10th judicial District Attorney saw this as what it was, an expression of free speech, thus curtailing a manhunt, further public humiliation and a possible federal prison sentence.

The Mayor and Council took offense to a flyer that was passed out to the community surrounding the old Whirlpool site warning of the demolition and redevelopment of 300 plus homes in south Cleveland. This flyer contained truthful and accurate information based on the last known public meeting where that information was provided. The White paper draft plan is the last known information that has been made available to the public in a public setting. Since much public outcry and protest of these proposed actions a revised edition of that plan has been revealed in what can be best construed as a change made in private setting.

Only after approximately 7 days of public humiliation was this latest information provided. The latest information was reportedly released after strong community concern and protest and the white paper was supposedly changed. This change then reflected the negation of the previous proposed draft that called for demolition and redevelopment of 300 plus homes in the downtown area. The latest adoption of this plan has not been made known to the public except when the press inquired about the original draft plan.

Since this time, the Tea Party of Bradley County held a town hall meeting. The Mayor and 7 council members were invited by certified mail. Only one councilman Bill Estes and one County Planner bothered to show up to confront approximately 150 civilians, a great portion residents from the Southside of Cleveland concerned about their livelihood and the security of their private property.

This would have afforded a great opportunity for this Mayor and his council to address their concerns and put them at ease. Instead with the exception of one city councilman, this governing body missed a fantastic opportunity to answer the citizens question they represent. This missed opportunity tells of the disconnect this body has with the people they represent.

I am convinced that this initial offering of information was only a shot across the bow of what is coming to our community, specifically the downtown area. Since this time we have heard further debate of eminent domain, demolition and development at the Ocoee/25th street exchange and on highway 60 around and through the Georgetown community, where many acres of private property will be taken by proposed growth plans. The exact action where just a few weeks prior this body condemned, reprimanded and investigated citizens of this county for informing the community about. With this doublespeak and deception I am convinced eminent domain will be a major implementation tool to revamp the downtown area and the county as the BCC 2035 Joint Strategic plan is further implemented. The Chambers Doug Berry has said it is a given, I draw from this comment that eminent domain will be used to develop our city and county. With this most recent resolution the Mayor and his council have successfully criminalized free speech in Bradley County.

This move by Mayor Tom Rowland created much fear and caused several to hide in fear of retaliation. Since the Mayors press conference basically calling this action illegal, mean spirited and untruthful has caused a great pummeling by the local media, the Chamber of Commerce, locally elected officials and planners on many citizens of Cleveland Tennessee. While siding with Mayor Rowland this group has relentlessy worked to discredit and tarnish the reputations of many within our group with lies and falsehoods further adding to the endless attacks upon it’s citizens and criminalizing our actions.

The Mayor and his Council with one swift vote has caused great harm to the citizens of this community. This action should embarrass this administration as efforts were made vigorously to squelch our first amendment rights. The attacks have been consistent and have even led to further allegations of potential wrong doing on the part of the Tea Party.

The damage and embarrassment this administration has done to this community can probably never be undone but this Mayor and City council by rescinding this resolution and replacing it with a new confirmation may start the healing process. I am asking that this governing body make the needed changes within the next 2 weeks of this date calling for a revision and replacement of the aforementioned resolution and a confirmation that our free speech rights will remain intact in perpetuity.

We must not let this action go unchecked because of the seriousness of it’s content for it’s citizens. No Mayor or representative of government at any level should have the power to stifle and quash free speech and plant fear into the hearts of its citizens at his will simply for exercising their God given constitutional rights to assemble, speak and redress our government.

Let me remind you that this is no game and you cannot simply throw your constituency to the wolves as a sacrificial lamb for your own selfish reasons. The lives you intend to destroy from this pulpit are not willing to continue to take your repeated lashing at their integrity. Playing with people’s lives at the risk of political expediency is a dangerous game and leaves many potentially hurt within the path of tyrannical behavior.

Our forefathers wrote the constitution to prevent the actions that the Mayor and his council have taken. No form of government should be so mighty and powerful to think it does not have to answer to the people or to the constitution that protects us all. No Mayor or his council should ever appear from behind our constitutional cover and lash out toward the people you represent while swinging a swath of destruction that has no boundaries.

We are asking Mayor Rowland and his council to publicly apologize and strike down his freedom eliminating resolution and replace it with another resolution proclaiming that our liberties and freedoms are restored and respected by a government that is clearly out of touch with it’s citizens.

Our actions to retain an attorney was decided upon after a thorough evaluation of the seriousness of the charges that were levied against Cleveland and Bradley County Citizens. The continuous attacks by our government and others have had a temporary and long lasting effect on the movement of our Tea Party and has caused many to “hide” from fear of misaligned exposure and criminalization. According to recent information provided this is not the first action by this council to squelch free speech, a pattern of abuse of power is now presenting itself.

We must shed light on this runaway government and end it’s frightening tactics. We must end the tyranny today, for those that may choose to live in Bradley County tomorrow.

Liberty must outlast tyranny, the attacks of a few should never be accepted as the political norm and the law of the land, placing the Constitution as an afterthought. It’s people must continue to fight regardless of the attempts to take away those rights and on occasion must stand to reclaim those rights given to us by God almighty.

Governor Haslams appointee to Tennessee Economic and Development Council appointee Samar Ali interned for the International Arab Bank and during her time there the bank was investigated and found guilty of laundering money in the 10s of millions to support suicide bombers of Hamas, the al-Aqsa Martyrs Brigade, the Palestinian Islamic Jihad and the Popular Front for the Liberation of Palestine. This recent appointment by Governor Haslam can’t make the Jewish community sleep well at night!

The New York based Holy Land Foundation was the US link to spread their money to terrorist based organizations like Hamas in the US and abroad, a close associate of the Arab Bank. Governor Haslam has now hired Mrs Ali, a Sharia Compliance expert to work within our own government.

Many Arab banks get away with “zakat” or “charity” as money to fund terrorists because for one it is “not politically correct” to say anything about it and two it is so layered with very little accountability as to where the money goes. Noone could possibly keep up with all the transactions or where it ends up. This I am sure is by design.

These charges saying the Arab Bank funneled and laundered money to terrorist organizations is part of an international and US investigation that has resulted in stiff fines and further investigation and monitoring of activity. In fact some charges are still ongoing and are expected to return further charges.

What were those various banking agencies? No one has asked that question nor has an answer been provided.

More on her association with the International Arab Bank and the Holy Land Foundation from a very interesting blog (which is listed at the bottom of this article and I encourage you to visit this site every chance you get for it is truly the leading authority on this subject)

While offering the same sanitized information as that coming from the Governor’s office, Rep. Debra Maggert (who has recently been relieved of her duties by her constituency) has suggested to her constituents who have questioned Ms. Ali’s appointment that they are simply overreacting.  Both she and Governor Haslam (who supported her in the primary and clearly needs to go because of his lapse in judgement) are appropriately focused on job creation.  As Rep. Maggert recently stated, “I’m squarely focused on the priorities of my voters: job creation and economic development” and help[ing] the private sector develop more job opportunities for Tennesseans.”

One question that neither Rep. Maggert nor the Governor are asking though, is, at what cost, in particular, the long-term cost to the foundation of our liberties?  Some have even questioned whether the Governor’s family Pilot gas business may be clouding his judgment.

Articles detailing a lawsuit filed in 2004 which is still on-going in 2012 involving this bank, refer to it by the shorthand “the Arab Bank”.  Information in Ms. Ali’s bio suggest that she was working at the bank during the pendency of the lawsuit.

In short, the lawsuit alleges that Arab Bank maintained financial links and funding for organizations and individuals involved in terrorism.  Specifically, it is alleged that Arab Bank enabled funding by wealthy Saudis to reach U.S.- named terrorist groups such as Hamas. Additionally, it is alleged that the money was used to induce volunteers for suicide bombing missions by making payoffs to their survivors.

The lawsuit states that Arab Bank financed Palestinian terrorism by “paying a ‘comprehensive insurance benefit’ of around $5,300 to families of suicide bombers on behalf of the Saudi Committee, a government-run charity”, and that financial records reflect that the committee wired this amount of money into accounts that families were told to set up at the Arab Bank.  It was reported that approximately 200,000 wire transfers were made totaling more than $90 million dollars.

Not only had the Justice Department started a criminal investigation in 2004, but in 2007, the bank was sued in a New York federal court by Americans and Israelis who had been injured by suicide bombers whose families had accounts at the Arab Bank.  The bank refused to disclose certain client records claiming protection under Jordan’s bank secrecy laws.  In July 2010, a federal District court judge ruled against the bank holding that Lebanon and Jordan’s privacy rules are void in matters involving terror financing.

A lengthy piece published in 2010 examined the bank’s annual reports and other related documents and reported the following:

A 2005 release fromm the U.S. Office of the Comptroller of the Currency and Financial Crimes Enforcement Network accused the bank of “failing to adequately control suspicious activity and for not maintaining proper anti-money laundering programs.” (the bank paid a $24 million fine for these violations)
A review of the bank’s annual reports over time reflected a strong connection between the political positions of the bank’s founders and the “provision of banking services to Hamas years after they were named terrorists.”
The 1964 annual report “celebrated” the founding of the Palestinian Liberation Organization and its mission as noted by the bank’s chairman to “return [the] occupied part of Palestine to the Arabs”
In 1968 the chairman’s message in the annual report cautioned that the Zionists posed a threat to the entire Arab world and that Arabs needed to “…sacrifice the lives and offer the money needed for the self-defense and for the liberation of their sacred places and all their occupied territories.”
More specifically, the suit alleged that at least 7 separate accounts “for Hamas-linked so-called charitable foundations facilitated the rapid transfer of donations (given by Arabs as zakat, a mandatory charitable tithe), between valid and efficient social-service groups and their sister organizations, the armed units that carry out the bombing attacks.” The suit claimed that Arab Bank used Hamas and Palestinian Islamic Jihad “martyr kits” to make the payments to survivors of the suicide bombers.

With regard to zakat, one document titled “Calculating Zakah” found on the Amana Mutual Funds website (Amana is considered the leading shariah compliant mutual fund group in the U.S., see also Newsletter #16), has a section titled “Who Receives Zakah?”.  This section has a list including the category “in the cause of God (fi sabilillah)” which in the index in Reliance of the Traveller, cross-references to the section on “Jihad”. This is further explained by, section h8.0 in the Reliance entitled “Giving Zakat to Deserving Recipients”; section h8.17 is specifically designated for “those fighting for allah” (jihadist combatants) ”), and their families (e.g., support for families of suicide bombers).

Looking at Ms. Ali’s past political and professional accomplishments, such as co-founding the Vanderbilt Middle Eastern Student Association with a Saudi undergraduate and then later on working on behalf of the Palestine Diabetes Institute, one has to wonder where this “lifelong Tennessean born and raised in Waverly” (as described by Governor Haslam), developed her passion for all things Palestinian and Arab?

In a strange twist of irony, it seems that Samar’s father, Subhi Ali shares the same pro-Palestinian anti-Israel sentiment as those associated with the Arab Bank’s lawsuit. 

Regardless of your opinion on this subject one very strong opinion resonates from this blog and my mother still says it to this day and I even tell my kids on occasion “you are known by the company you keep!” For example, If I hang around and frequently visit a church, I am going to be associated with that church. If I hang around and intern at an international Arab bank that has been convicted of laundering money to and in support of Hamas suicide bombers then I am know by that association.

At the very least this should be investigated and Governor Haslam forced to answer questions instead of sweeping it under the rug just because a few people says it doesnt exist or isn’t politically correct.

That simple denial used to work before the Internet and it’s descriptive revelations that are easily revealed within a google search, not anymore. The truth can be easily seen and a simple naysayer no longer has influence.

We live in very dangerous times and breaches of our government security by anyone especially a Governor of our state should not go unanswered. We are hearing report that the Muslim Brotherhood has infiltrated DC and the White House and has many tentacles all the way into local government. Could this possibly be one of those tentacles? Why are we ignoring it and not connecting the dots? I would rather err on the side of national security than choose to watch as our country becomes unsafe at a time when it calls for us to be cautious.
